- Human trafficking, exploitation, or abuse; or
- Any other unlawful activity.
2.Fraud and Deception
You may not use the Services to:
- Defraud, deceive, or mislead any person or organization;
- Operate or participate in Ponzi schemes, pyramid schemes, or similar schemes;
- Impersonate another person or organization;
- Misrepresent the purpose of a transaction;
- Conduct phishing, social engineering, or identity theft;
- Distribute funds obtained through theft, fraud, hacking, or other unlawful means; or
- Facilitate investment scams or fraudulent financial products.
4.Restricted Goods and Services
You may not use the Services in connection with transactions involving:
- Illegal drugs or controlled substances;
- Illegal weapons or prohibited weapon-related activities;
- Explosives or other dangerous materials;
- Stolen goods;
- Counterfeit goods or intellectual property infringement;
- Child sexual abuse or exploitation material;
- Human trafficking or exploitation;
- Illegal gambling activities;
- Fraudulent or deceptive products and services; or
- Any other goods or services prohibited under applicable law.
5.Harmful Use of the Platform
You may not:
- Interfere with, disrupt, or damage the Services or their underlying infrastructure;
- Attempt to gain unauthorized access to user accounts, systems, wallets, APIs, smart contracts, or networks;
- Introduce malware, viruses, or malicious code;
- Exploit vulnerabilities or attempt to bypass security controls;
- Conduct denial-of-service attacks or other disruptive activities;
- Use automated systems in a manner that negatively impacts the availability or security of the Services; or
- Reverse engineer or misuse the Services except where permitted by applicable law.
6.Sanctions and Restricted Jurisdictions
You may not use the Services if you are located in, ordinarily resident in, or acting on behalf of a person or entity located in a jurisdiction subject to comprehensive sanctions or other applicable restrictions.
You may also not use the Services if you are subject to applicable sanctions or listed on any applicable sanctions or restricted-party list.
Fundable may restrict or suspend access to the Services where required by applicable laws, regulations, sanctions, or its compliance obligations.
7.Misuse of Payment and Distribution Features
Users must not use Fundable's payment, streaming, recurring payment, mass payout, distribution, or conversion features to:
- Circumvent applicable financial regulations;
- Conceal the source or destination of funds;
- Structure transactions to avoid reporting or compliance requirements;
- Process transactions on behalf of unknown or unauthorized third parties;
- Facilitate prohibited or illegal fundraising activities; or
- Engage in any activity intended to disguise, obscure, or misrepresent the nature of a transaction.
8.User Responsibility
You are responsible for:
- Ensuring that your use of the Services is lawful;
- Providing accurate and complete information when requested;
- Maintaining the security of your accounts and credentials;
- Obtaining any licenses, permissions, or approvals required for your activities; and
- Ensuring that recipients and counterparties involved in your transactions are legitimate and authorized.
9.Monitoring and Enforcement
Fundable may monitor transactions, accounts, and use of the Services to the extent necessary to maintain platform security, comply with applicable laws, prevent prohibited activity, and enforce this Policy.
Where Fundable reasonably believes that a user has violated this Policy, it may take one or more actions, including:
- Requesting additional information or verification;
- Restricting or suspending access to the Services;
- Delaying or declining supported transactions where permitted;
- Terminating an account or access to the Services;
- Reporting suspected illegal activity to relevant authorities or compliance partners where required or appropriate; and
- Taking any other action reasonably necessary to protect Fundable, its users, partners, and the integrity of the Services.
10.Changes to This Policy
Fundable may update this Acceptable Use Policy from time to time. Continued use of the Services after an updated Policy becomes effective constitutes acceptance of the revised Policy.
